La misma garantiza la calidad de los mismos y especifica el alcance y validez de la SUPERGARANTÍA.1 - SUPERGARANTÍA limitada de 2 años de los paneles solares marca Eastech.Eastech Solar S.A.U. garantiza que el panel solar está libre de defectos y/o fallos mecánicos y/o eléctricos de la naturaleza que a continuación se detalla, por un periodo de 2 años a contar desde la fecha impresaen la factura al cliente* de Eastech Solar S.A.U.+ Fallos debidos a una fabricación defectuosa del panel+ Fallos motivados por la utilización de materiales defectuosos+ Agrietamiento de la superficie frontal de vidrio, motivado por objetos extraños en su interior **, nunca será objeto de cobertura de garantía si el agrietamiento del panel se debe a por factores exógenos a lafabricación del panel, tales como vandalismo, granizo, tensión externa inadecuada, etc+ Falta de conformidad con las especificaciones relativas a producción defectuosa y/o procesos de inspección.Si el panel solar Eastech fallara de acuerdo a lo especificado en esta SUPERGARANTÍA, Eastech Solar S.A.U. reemplazaría o repararía el panel defectuoso al cliente en un plazo máximo de 75 días desde la fecha de su comunicación por escrito.2 – SUPERGARANTÍA limitada de capacidad y rendimiento de los paneles solares marca Eastech.A) Eastech Solar S.A.U. garantiza dentro de los diez primeros años desde la fecha de venta del panel al cliente un rendimiento medio superior al 90% de la tasa mínima especificada como potencia nominal del panel.B) Eastech Solar S.A.U. garantiza entre el undécimo y vigésimo quinto año desde la fecha de venta del panel al cliente un rendimiento medio superior al 80% de la potencia nominal del panel.Los valores de rendimiento y medición serán aquellos, medidos bajo los estándares y parámetros demedición de Eastech Solar S.A.U., y que vienen claramente descritos en nuestro catálogo general de producto y que igualmente figuran en el flash report.Si durante los primeros diez años se detectase un rendimiento inferior al garantizado en este apartado de la SUPERGARANTÍA (90%), se tendría que comunicar fehacientemente este supuesto a Eastech Solar S.A.U., y tras las verificaciones oportunas, si se demuestra que son los paneles solares, los que por su propia naturaleza, de forma endógena, no son capaces de dar el rendimiento prometido, Eastech Solar S.A.U. se compromete a proporcionar tantos paneles solares como sean necesarios para garantizar los límites inferiores acordados en este contrato de SUPERGARANTÍA, teniendo en cuenta como potencia instalada la suma del número de paneles multiplicado por su potencia nominal ( 3% ), siendo el plazo máximo para la entrega de los paneles adicionales 75 días desde la fecha en la que se demuestre que el inferior rendimiento de la instalación es consecuencia directa del bajo rendimiento de los paneles solares marca Eastech.Si entre el undécimo y vigésimo quinto año, se detectase un rendimiento inferior al garantizado en este apartado de la SUPERGARANTÍA (80%), se tendría que comunicar fehacientemente este supuesto a Eastech Solar S.A.U., y tras las verificaciones oportunas, si se demuestra que son los paneles solares, los que por su propia naturaleza, de forma endógena, no son capaces de dar el rendimiento prometido, Eastech Solar S.A.U. se compromete a proporcionar tantos paneles solares sean necesarios para garantizar la potencia nominal de la citada instalación, que se obtiene de multiplicar la potencia nominal de cada panel por el número de paneles instalados. Siendo el plazo máximo para la entrega de los paneles adicionales 75 días desde la fecha en la que se demuestre que el inferior rendimiento de la instalación es consecuencia directa del bajo rendimiento de los paneles solares marca Eastech.3- SUPERGARANTÍA limitada de tolerancia.Todos los paneles solares marca Eastech, y comercializados por la empresa Eastech solar S.A.U. , garantizan al cliente una tolerancia máxima y mínima, que fluctúa entre el -3 %/+5% , dependien-do del modelo y familia de panel solar. Eastech Solar S.A.U. garantiza las citadas tolerancias, y para ello envía a cada cliente un flash report con cada entrega de paneles solares y se compromete mediante esta SUPERGARANTÍA a suministrar en el conjunto del pedido realizado, siempre una potencia igual o superior para el conjunto del pedido, y si una vez se recibe el Flash report, se comprueba que lo suministrado está fuera de los límites de tolerancia admitidos, Eastech Solar S.A.U. se compromete a suministrar tantos paneles fuesen necesarios para garantizar el grado de tolerancia comprometido mediante este contrato de garantía, de tal forma que la suma de las potencias de los paneles suministrados siempre sea mayor o igual a la suma de la potencia nominal de todos los paneles solares solicitados, y la citada repotenciación se haría en un plazo máximo de 75 días desde la fecha en la que se demuestre la veracidad de tal supuesto. Si transcurrido un mes desde la entrega del flash report no existiera reclamación alguna por escrito, ambas partes entienden que la tolerancia entregada es satisfactoria y admitida por las partes.4- Exclusiones de la SUPERGARANTÍA.A) No se podrá hacer reclamación alguna sobre esta SUPERGARANTÍA limitada una vez finalizado el periodo en el que se aplica la SUPERGARANTÍA. La reparación, sustitución, reemplazo, entrega de paneles adicionales o reintegro del importe, no prolongará en modo alguno los téminos originales de esta SUPERGARANTÍA limitada.B) Esta SUPERGARANTÍA limitada no es aplicable a los defectos y/o fallos de los paneles solares originados por las siguientes causas, a pesar de que los citados defectos pudieran ser descubier-tos durante el periodode validez de la SUPERGARANTÍA.1- Defectos originados por dispositivos o piezas ajenas al panel solar o por métodos de montaje de dichos dispositivos2- Defectos originados por cableado defectuoso, deficiente instalación o errónea manipulación, o por un ambiente inapropiado de no conformidad con las especificaciones de los manuales de funcionamiento.3- Defectos ocasionados con intencionalidad o por ausencia o ineficiente control, reparación y mantenimiento.4- Defectos originados por cambiar el panel de su emplazamiento original5- Defectos originados por no reparar el panel de acuerdo a los procedimientos de Eastech SolarS.A.U.6- Defectos originados por inapropiada manipulación durante el proceso relativo a la logística (transporte, almacenaje y distribución) del panel solar.7- Defectos ocasionados por su uso en unidades móviles.8- Defectos originados por accidentes y/o catástrofes naturales y/o de fuerza mayor,imprevistos o previstos tales como incendios, explosiones, huracanes, Tsunamis, tornados, relámpagos, tifones, terremotos, actividades volcánicas, lluvia ácida, humos, sal, etc..9- Defectos ocasionados por la eliminación de los conectores solares que son la prolongación del panel e indispensables para garantizar un óptimo rendimiento del panel.5- Aplicación de la SUPERGARANTÍAEsta SUPERGARANTÍA es aplicable solamente a los clientes que hayan comprado el panel solar directamente a Eastech solar S.A.U., o a cualquiera de sus agentes autorizados. Para gozar de la SUPERGARANTÍA limitada es necesario cumplir con los procedimientos, acreditar las disfunción o fallo y facilitar la factura de compra que garantiza su legítima adquisición. Cuando se solicite la aplicación de la SUPERGARANTÍA Eastech, será necesario proporcionar junto con elpanel solar Eastech, el modelo, el número de serie, una descripción de la anomalía que se contempla,evidencias que lo acrediten y acompañar la factura de compra.Cualquier panel desinstalado pasará a ser propiedad de Eastech Solar S.A.U., y esta, tendrá derecho a entregar para su sustitución otro tipo de panel de diferente tamaño, color, forma, capacidad, diseño, etc..Aunque siempre de potencia igual o superior al sustituido. Esta SUPERGARANTÍA limitada podrá transferirse al nuevo propietario siempre que se notifique ehacientemente a Eastech Solar S.A.U. y siempre que el citado panel permanezca instalado en el mismo lugar de su primera instalación. Para determinar el alcance del defecto del panel y la causa del mismo, así como sobre quién recae la responsabilidad de la posible solución, Eastech Solar S.A.U. designará a una ingeniería o laboratorio independiente para que de forma neutral, objetiva y honesta determine el alcance, el origen y la responsabilidad del mismo, siendo sufragado el coste de este servicio por parte del cliente al 100%, pero de demostrarse la responsabilidad de Eastech solar S.A.U. y al ser necesaria la aplicación de la SUPERGARANTÍA, Eastech Solar asumiría el 50% del coste del servicio, de forma que compartiese con el cliente a partes iguales el importe de la factura correspondiente a las labores de investigación, análisis y pruebas necesarias para encontrar las causas y el origen del defecto.6- Restricciones de la SUPERGARANTÍALa presente SUPERGARANTÍA limitada excluye cualquier otra garantía, a menos que exista por escrito, con fecha posterior al actual documento de SUPERGARANTÍA algún otro documento firmado por algún miembro del consejo de administración de Eastech Solar S.A.U. en cuyo caso se admitiría como documento válido la susodicha garantía, diferente a lo expresado en este documento de SUPERGARANTÍA que se entiende como válida y universal para el territorio Español. This SUPERWARRANTY is limited, and it is only for the PV solar modules manufactured and branded under the registred Eastech brand for the Spanish territory or any other territory agreed in advance by the seller and buyer.This SUPERWARRANTY card, guarantee the quality of the PV solar modules, the validity and the procedures to follow in case to need to be used.1 – The Guarantee is limited up 2 years for the PV solar modules Eastech brand.Eastech Solar S.A.U. guarantee the PV solar modules manufactured are free of any manufacturing defect including mechanical and electrical aspects. The SUPERWARRANTY given is for two years from the date of the Eastech Solar SAU has invoiced the PV solar module. Below we can find the different issues and aspects ruled in order to be followed by the final user as important info, for a hypothetical replacement if the solar modules delivered include such kind of defects:+ Defects due to a bad manufacturing+ Defects due to a bad quality raw materials+ Glass surface cracking due to a dirty or strange ítems inside the glass. **** Is out of this SUPERWARRANTY hailstone, overtension, vandalism, etc.. or any other kind of cracking which is not responsibility of the manufacturer.+ If the manufacturer has not fulfil its specifications and it is not according the specifications, including a defective quality control and or inspection process. If the Eastech PV solar module fail due to any of the above written points in this SUPERWARRANTY card, Eastech Solar SAU will replace the defective PV solar module by the buyer in no more than 75 days after to Proof the issue and communicate it by written.2 – Capacity and Performances for the Limited SUPERWARRANTY of the Eastech brand PV solar modules.A) Eastech Solar S.A.U. guarantee a 90% of the nominal power of the PV solar module Eastech brand during the first 10 years life. From the date of the invoice***.B) Eastech Solar S.A.U. guarantee between the year 11th and the year number 25th from the invoiced date to the customer at least a 80% performances from the nominal power ordered from the customer with the goods.***The performances parameters will be those, measured under the Eastech Solar SAU standard, and can be clearly seen and read in the Eastech Solar product Catalogue. If during the first 10 years life of the PV solar module somebody detect and Proves seriously by evidences, the performances of the PV solar modules Eastech brand are below 90%, in that moment should be communicated by a written way to Eastech Solar SAU, and if after to check carefully the installation by an expertise person or company, it is demonstrated the PV solar module/s fail/s, and can not give to the customer the promised performances, Eastech Solar SAU has the obligation to provide all the necessary panels to replace the low performances panels and admited tolerance (-3%). Taking note that Eastech Solar SAU would consider low performances PV solar modules, all the PV panels which the power is less than the Nominal power, and then the modules must be replaced, or the plant must be re-powered in less than 75 days from the moment of the final agreement between the parties. If from the year 10th to the year 25th of the PV solar modules Eastech brand, somebody detect and Proves seriously with evidences, the performances of the PV solar modules Eastech brand are below 80%, in that moment should be communicated by a written way to Eastech Solar SAU, and if after to check carefully the installation and the PV solar module/s is demonstrated the PV solar module/s fail/s, and can not give to the customer the promised performances, Eastech Solar SAU has the obligation to provide all the necessary panels to replace the low performances panels. Taking note that Eastech Solar SAU would consider low performances PV solar modules all the PV panels which the power is less than the Nominal power and admited tolerance (-3%), and then, the modules must be replaced, or the plant must be re-powered in less than 75 days from the moment of the final agreement between the parties.3- Tolerance Limited SUPERWARRANTY.All the Eastech brand PV solar modules sold through Easteh Solar SAU company are guaranteed under a maximun and minimum tolerance, and the tolerance is between -3%/+5% individually module by module, depending the model, family and efficiency cell. Eastech Solar S.A.U. guarantee that tolerance and for that reason send to their customers together with the product delivered a flash report and its commitment to provide always the same or more power according the nominal power of total P.O. delivered, that means positive tolerance to the full delivery. If the summary of the PV solar modules delivered to the customer are out of our tolerance range, that means below the full power ordered, Eastech Solar SAU would provide free of charge all the power needed to balance the total power ordered and paid by the customer in a no longer time than 75 days. If individually speaking, any of the solar PV modules delivered are below the negative range (-3%), then, Eastech Solar SAU would replace that piece no later than 75 days after the communi-cation from the customer by written. If there is no written complaint after delivery of flash report, both parts understand that the delivered tolerance is satisfactory and accepted by the parts.4- OUT of Limited SUPERWARRANTYA) Can not be done any claiming about the SUPERWARRANTY once the Limited SUPERWARRANTY has been expired. And that SUPERWARRANTY can not be extended under any circumstance.B) This Limited SUPERWARRANTY can not be applied if the fails or defects found on the PV solar modules has been generated by one or more of the following causes, even if the defects has been detected or found within the SUPERWARRANTY period.1- Defects caused by devices or pieces out of the PV solar module or due to wrong installing methods.2- Defects caused by a wrong cabling/wring, wrong installation, wrong operation, wrong manipulation of such devices or an inappropriate environment.3- Defects caused due to a bad following of the user and working manual4- Defects caused due a bad intention, bad or no control, repairing and maintenance5- Defects caused due to a bad repairing procedure, not according with the manufacturer rules.6- Defects caused due to a logistic issues (transport, handling, warehousing, distribution, etc..) of the PV solar module.7- Defects caused due to a installation made in mobile units.8- Defects caused by accidents, natural disasters, Force majeure, out of control activities as explosions, bombs, hurricanes, Tsunamis, Tornados, thunders, earthquake, vulcans activities, smokes, etc…9- Defects caused by deletion of solar connectors, that are an extension of the panel and necessary to ensure the optimun performance of the panel.5- Limited SUPERWARRANTY ApplicationThis Limited SUPERWARRANTY is only valid for the customers who or which has bought directly the PV solar module to EASTECH SOLAR SAU, or to any of the authorized dealers. To use this Limited SUPERWARRANTY is necessary to apply some procedures and to prove defects or fails which affects to the normal working, and is completely necessary to show and to send by fax or e-mail scanned the purchasing invoice. When a customer ask to use the Limited SUPERWARRANTY, it will be necessary to provide to Eastech Solar SAU the following data;+ Defect or fail description+ Evidences+ Modelcode+ Serial number+ Purchasing invoiceAny PV solar module uninstalled and delivered back to Eastech Solar SAU will be automatically property own and Eastech Solar SAU will replace that PV solar module by other, and that PV solar module delivered to be replaced could be with different size, measures, way, colour, design, capacity, although always with the same or more power than the PV solar module replaced. This Limited SUPERWARRANTY can be transferred to a new owner, but always must be communicated by a written way to Eastech Solar SAU, and the PV solar modules can not be moved from the same venue where it has been installed at first time. To define the PV solar module defect and the origin of the defect, and also who or which is the legal responsible to provide the solution. Eastech Solar will look for a independent Lab or independent engineering company and in a neutral, objective and honest way will decide and explain the origin and the responsibility, and the cost of that external company will be covered by the customer at 100%, however if the independent lab or independent engineering demonstrate the defect is responsibility of Eastech Solar SAU, the manufacturer will pay 50% of the service cost, sharing with the customer the cost of the invoice.6- SUPERWARRANTY RestrictionsThe current SUPERWARRANTY is limited and exclude any other kind of previous SUPERWARRANTY, except if the customer can provide any other special or added SUPERWARRANTY by a written way as an up dating which affect to its Eastech PV module within the purchasing date period, or any other kind of document signed and stamped by the BOD of Eastech Solar SAU. In that case, the special SUPERWARRANTY would be accepted as valid SUPERWARRANTY document for the Spanish territory and abroad.Eastech Solar S.A.U. will have not any responsability about the potential damage caused by a deficient working of the PV solar module, and the responsibility will be limited to replace the PV solar module damaged or to make a credit note to the customer for the same amount paid in advance for the customer and to balance the amount pending due to this issue, or to re-power the plant if it is needed.
