The Alternative Energy practice is responsible for more than 100 renewable energy and alternative fuel projects across the globe. Moreover, Baker Botts has taken an active role in industry organizations such as the American Wind Energy Association (AWEA) and the Texas Renewable Energy Industry Association. Clean Energy Projects
Many of our traditional clients are engaged in efforts to find new sources of cleaner burning energy through sophisticated new technology such as the extraction of natural gas from shale. Baker Botts is one of the leading firms in assisting clients in acquiring shale assets. Similarly Baker Botts has assisted clients in development of coal methane, carbon capture and sequestration and cutting edge ventures such as a $7 billion coal to liquids facility to produce ultra-clean diesel, jet fuel and naphtha.
Baker Botts advises investors and developers on renewable power projects involving wind, geothermal and solar technologies in the U.S. and elsewhere. Internationally, we served as lead project counsel in the development and financing of a Liberia-based biomass-fired electric power generation project. In the U.S. we have served as project counsel in the development of more than 85 renewable power projects in 25 states, including regular representation of two of the U.S.’s top four wind developers, and have provided counsel to investors in the world’s largest solar power plants. Our team includes lawyers experienced in project development and finance, real estate, state and local property tax and state and federal regulation over development of such power projects and related transmission.
Smart Grid Technology
We also offer experience on the implementation of “smart grid” energy efficiency technology. We represent a leading energy delivery company that is engaged in the installation of 2.4 million high-tech smart meters and related communications and equipment to create an Advanced Metering System (AMS) that will collect, store and transmit data about customer electricity usage.
Baker Botts has helped clients in obtaining grants and loan guarantees from the Department of Energy (DOE) related to alternative energy projects. We have experience in negotiating with outside investors to develop innovative structures that achieve ideal utilization of Treasury grants, ITCs, PTCs, DOE guarantees and grants, as well as federal and state taxes and other incentives.
